Privacy Policy

(A.) General provisions

1. The Executor is the holder of the copyright and property rights of the "MyRent" software system, while the user, by using the software system, has acquired the exclusive right to use the system without the possibility of any exploitation of the system with the aim of acquiring property and/or copyright rights.
2. The user undertakes not to disclose the terms and conditions and method of using the "MyRent" software system to third parties and is warned that any disclosure of the terms and conditions and method of using the software system constitutes a violation of trade secrets.

• Any possible copying of data, screens or functionality of the system as a whole, whether by the user or a third party, constitutes a violation of the intellectual property of the perpetrator, for which the potential violator will bear the consequences provided for by law.

3. The contractor will familiarize the user with the function and purpose of the "MyRent" software system, and if necessary, the user can contact the technical support of the software system.

• The contractor undertakes to eliminate any reported and observed irregularities in the operation of the "MyRent" software system as soon as possible.
• The Contractor is not liable to the user for any damage caused by deactivation of the "MyRent" software system.
• In the event of a need for special changes in the "MyRent" software system, the user may contact the executor with a request, which the executor will consider and respond to within an appropriate period of time.

4. The Contractor undertakes to monitor the "MyRent" software solution during the use of the system by the user and to provide free advice regarding the use of the software system. The term "monitoring the software solution" means the alignment of the "MyRent" software system with amendments to the Act and other mandatory regulations relating to the software system and which are incorporated into the "MyRent" software solution, which the Contractor undertakes to carry out as soon as possible.
5. The user undertakes to correctly record their own data necessary for the operation of the "MyRent" software system on a medium for archiving or recording data.

• The Contractor shall not be liable for any loss of part or all of the User's data, whether due to a failure of the User's computer equipment or any other reason beyond the Contractor's control and responsibility.

(B.) Obligations of the executor

1. Maintain the "MyRent" software system and system settings in a usable state in accordance with its purpose and intended use.
2. Advise the user on the methods and possibilities of using the "MyRent" software system during system installation.
3. Monitor the operation of the "MyRent" software system and eliminate any deficiencies in the operation of the system as soon as possible.
4. Provide customer support to the user on weekdays from 09:00 to 16:00, either via the modem telecommunications system or by providing support at the user's premises, whereby customer support at the user's premises is additionally charged in accordance with the Contractor's Price List, which is an integral part of these Terms of Use.
5. Harmonize the "MyRent" software system with amendments to positive regulations whose content is related to software systems.

(C.) User obligations

1. Use the "MyRent" software system in accordance with the instructions and rules of the executor.
2. Back up your own data on a designated medium, in accordance with the rules of IT procedures.
3. Maintain the computer equipment on which the "MyRent" software system is used in a proper and secure condition.
4. Pay the contractor a fee for using the software system within the stipulated and agreed deadlines.
5. Refrain from any action or procedure that could cause either material or non-material damage to the executor or a third party in the use or in connection with the use of the software system.
6. Monitor legal regulations and changes related to guest registration and stay, as well as relevant tax regulations.

(D.) Confidentiality and privacy of data

1. The Contractor undertakes to permanently maintain the confidentiality of all user data obtained in connection with the use of the "MyRent" software system.
2. The Contractor undertakes not to sell or provide any collected data to third parties.

(E.) Maintenance and possible damages

1. The Contractor shall not be liable for direct, special, incidental or consequential damages resulting from either improper use of the "MyRent" software system or from malfunction of the user's hardware.
2. The Contractor bears no responsibility for other programs and/or stored user data, nor for data in the software solution that was created under the influence of other software solutions.
3. The Contractor undertakes to maintain the software system and settings of the "MyRent" system in a condition for use for its intended purpose, whereby the Contractor undertakes to act with the care of a good professional in maintaining the system.

• The Contractor reserves the right to interrupt synchronization and connections at shorter intervals for the purpose of necessary and urgent system upgrades and/or maintenance, and cannot be held responsible for errors resulting from interruptions in connection and synchronization.
• In the event of a harmful event occurring in connection with the use of the "MyRent" software system, the executor is liable to the user only for the damage caused by the executor's intent or gross negligence, while the executor's liability for any damage to the user or a third party caused by the executor's ordinary negligence, accident, force majeure, or the actions of the user himself or a third party is excluded.

(F.) Establishment of Channel Manager system and further mergers

1. After successfully completing the connection, the user is obliged to check the status on all connected booking portals and confirm that the status and data are up to date.
2. The Contractor may be held liable for incorrectly entered data and values that are reflected within 24 hours of connecting to the channel manager. The Contractor may not be held liable for entering incorrect data if the same has already been incorrectly submitted by the client.

• 24 hours after the connection has been successfully completed and the data entered, the User bears full responsibility for all incorrect data and values that the Provider sends to booking portals or the web.

3. The Contractor cannot be held responsible for omissions by booking portals and other web servers.

(G.) Payment and other terms

1. The user has the right to cancel the use of the "MyRent" software system to the contractor at any time without notice.

• The Contractor will not charge the user a fee for using the "MyRent" software system for the month in which the use of the system is canceled, except in the event that the user cancels the use of the software system within the last 5 days of the month, in which case the fee will be calculated for the user in accordance with the provisions under section C. (USER OBLIGATIONS), Art. 4 of these Terms of Use.
• In the event of cancellation of the use of the "MyRent" software system, the contractor undertakes to allow the user access to their own user data within 6 months from the date of cancellation of the contract.

2. The user is not authorized to transfer rights and obligations arising from the use of the "MyRent" software system to third parties without the express written consent of the executor.

The Contractor has the right at any time to change the provisions of the Rules for Using the "MyRent" software system as well as the Price List for Using the "MyRent" system as an integral part of the Rules for Using the "MyRent" software system, which changes are obliged to be published in the usual manner on the Contractor's website.

Any amendment to the Rules for using the "MyRent" software system and the Price List for using the "MyRent" software system shall be binding on the executor and every user who uses the "MyRent" software system at the time of publication of the amendments.

The User and the Executor undertake to try to resolve any disputes in the application of this Agreement amicably, while otherwise submitting to the decision of the competent court in Zagreb, whereby the applicable law is Croatian law.
